Terms of service

Plain-English terms for using Tack: free, as-is, no warranty, your content stays yours.

In one sentence

tack. is a free tool that runs in your browser. Use it however you like. We make no guarantees about it, and we have no control over what you do with the output. Your content stays yours.

Acceptance

By using tack. at tack.pics (the “Service”) you agree to these terms. If you do not agree, do not use the Service. We may update these terms; the updated version applies to your use after the change is published.

What the Service is

tack. lets you mark points and polygon regions on images and export the resulting coordinates as JSON or YAML. The Service is provided through a static website that runs entirely in your browser. There is no server-side processing of your content, no account, and no login.

See the privacy statement for details on what data is and isn’t collected.

Cost

tack. is free to use. There is no paid tier, no trial, no subscription. We may add optional paid features later, in which case the free version of the Service will continue to work.

Your content

  • The images you load into tack. and the coordinate data you generate are your content. You retain all rights you had to that content before you used the Service.
  • We claim no ownership over, and acquire no licence to, anything you load into tack. or anything tack. generates from it. Because nothing is uploaded, we never see it.
  • You are responsible for ensuring you have the right to process the images you load (for example, that they are not someone else’s copyrighted material being used in a way that infringes).

Acceptable use

Don’t use the Service to:

  • Try to break, reverse-engineer, deface, overload, or otherwise attack the website infrastructure.
  • Probe for vulnerabilities other than via responsible disclosure to the contact address below.
  • Wrap, rebrand, or commercially redistribute the hosted Service as your own.
  • Process content in a way that violates the law where you live or operate.

Building paid products that consume the JSON or YAML output is fine — that’s what the tool is for.

Intellectual property in the Service

The tack. source code, branding, copy, and visual design are © Smoking Media unless otherwise noted. The exported JSON/YAML data structures are simple data; we do not claim any rights over the schemas themselves.

Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE OUTPUT IT PRODUCES WILL BE CORRECT FOR YOUR USE CASE. ALWAYS VERIFY EXPORTED COORDINATES BEFORE RELYING ON THEM IN PRODUCTION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL SMOKING MEDIA OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

The total cumulative liability of Smoking Media to you for any and all claims relating to the Service shall not exceed €50 or the equivalent in your local currency.

Termination

You can stop using tack. at any time, no action required. We may suspend or discontinue the Service at any time without notice. Because nothing is uploaded, you do not need to “export your data” before leaving — there is no data on our side to export.

Governing law

These terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved informally will be brought before the competent court in Amsterdam, unless mandatory consumer-protection law in your country requires otherwise.

Severability

If any part of these terms is held unenforceable, the rest remains in effect.
